Information sources and data handling
This section provides information on public information, sources of information on emissions trading and how personal and business data are processed within the EU ETS.
Some information about the EU emissions trading system is public. This includes information on allocation and compliance for operators in the EU ETS and which organisations are listed as account holders in the Union Registry. Transactions older than three years are also public information.
Confidentiality and handling of data and personal data
Information in the Union Registry on account representatives, account balances and information on transactions is published only at the account type level as detailed information is confidential under EU law and the Swedish Public Access to Information and Secrecy Act.
Article 80(1) of the Registry Regulation (2019/1122)
All information, including the holdings of all accounts, all transactions made, the unique unit identification code of the allowances held or affected by a transaction, held in the EUTL and the Union Registry shall be considered confidential except as otherwise required by Union law, or by provisions of national law that pursue a legitimate objective compatible with this Regulation and are proportionate.
Chapter 31 Section 11 of the Act on Public Access and Confidentiality (2009:400)
Confidentiality applies in activities relating to the maintenance of the Union registry for emission allowances referred to in the Act (2020:1173) for information that provides or contributes to information about the balance of an account in the registry, unless it is clear that the information can be disclosed without the account holder suffering harm. Data in the Union Registry
The Union Registry stores data regarding:
- Accounts of EU Member States, legal and natural persons with commitments or holding allowances.
- Transactions of units to and from accounts in the registry. There are different types of transactions: issuing allowances, free allocation, auctioning, transactions between accounts, surrender and removal of units. The Union Registry also stores data on transactions for the national registries under the Kyoto Protocol.
- National allocation tables indicating allowances allocated free of charge to stationary installations and aircraft operators.
- Verified emissions and surrendered allowances from all operators covered by the EU ETS.
All national registries within the EU are identical in terms of functionality, operation, maintenance and basic security requirements. The functions are regulated in a specific registry regulation.
According to this Registry Regulation, the Commission shall ensure that the Union Registry stores information on all processes, listings and account holders for five years after an account has been closed. Personal data of users in the registry are anonymised five years after a user has had their access to the registry revoked.
The Union Registry also contains Sweden's national registry under the Kyoto Protocol, where the national commitment is monitored. From 2013, the Union Registry also contains the registry for accounting for emissions under the Effort Sharing Decision (406/2009/EC).
The registry only records completed transactions between two parties. Parties administer their own emission allowances and in the event of a sale, it is the seller who transfers emission allowances from their account to the buyer's account. Contracts or prices are never recorded in the Union Registry.
Controls
Controls are carried out to ensure that all transactions from one account to another comply with the rules of the trading system. Every day, all data in the Union Registry is checked to ensure consistency and integrity. This process is called reconciliation. Any inconsistencies are reported immediately and affected accounts or entities may be blocked until the inconsistency is resolved.
The Swedish Energy Agency as data controller
The Swedish Energy Agency is the data controller for the processing of personal data carried out in our operations. This entails an obligation to comply with the provisions of the General Data Protection Regulation (2016/679). We process personal data for various purposes. It is often necessary for different types of contact information to be needed for the agency to be able to fulfil its tasks.
The Swedish Energy Agency, in its role as national administrator, requests, among other things, personal data relating to private individuals. Personal data is defined in the General Data Protection Regulation as:
”any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.”
Anonymisation of personal data in the Union Registry
Anonymisation of a user's personal data in the Union Registry takes place five years after the user (representative) has had their access to the Union Registry revoked. The user can decide to un-enrol from the Union registry, thereby revoking access. Another representative representing the same account holder, the account holder signatory, or the Swedish Energy Agency in its role as national administrator can also revoke access.

Extract from the criminal record
According to EU Regulation 2019/1122, the national administrator may request information from the competent authority responsible for the criminal record. In Sweden, the Swedish Police Authority is responsible for the criminal record extracts.
According to Section 16g of the Criminal Record Regulation (1999:1134), the Swedish Energy Agency may request a criminal record extract from the Swedish Police Authority.
The purpose of requesting an extract from the criminal record is if the Swedish Energy Agency intends to register or has registered a person as an account holder or representative in the Union registry referred to in Section 19 of the Act (2020:1173) on certain greenhouse gas emissions and, if the matter concerns a legal person, a signatory for this person.
Who is covered by the requirement?
The Swedish Energy Agency obtains a criminal record extract in the following cases:
- When opening a trading account in the Union Registry, the Swedish Energy Agency obtains a criminal record extract for the account holder's signatory(s).
- When applying to become a new representative. This applies regardless of the account type.
- When updating documentation for the account holder or representative.
How does it work?
The Swedish Energy Agency sends a request to the Police Authority for a criminal record extract. Criminal record extracts are destroyed after the account has been opened or in connection with an update of documentation in accordance with the Registry Regulation (2019/1122).
Which crimes are disclosed in the criminal record extract?
The crimes disclosed in the criminal record extract according to Section 16g of the Regulation on the Criminal Records Register (1999:1134) are the following:
- Chapters 8–11, 14 or 15 of the Swedish Penal Code (1962:700),
- the Tax Offences Act (1971:69),
- the Act on Penalties for Money Laundering Offences (2014:307),
- the Act on Penalties for Market Abuse on the Securities Market (2016:1307),
- the Act on certain greenhouse gas emissions (2020:1173), or
- the Act on Penalties for Terrorist Offences (2022:666) or equivalent older legislation.
If the penalty also relates to a crime other than those specified in the second paragraph of the act (16a), information about that crime must also be disclosed. The extracts requested by the Energy Agency will be destroyed after review in accordance with Section 16g of the Regulation (1999:1134) on criminal records.

Public information sources about the EU ETS and the Union registry
Statistics and monitoring of emissions
The Swedish Environmental Protection Agency annually compiles preliminary statistics for emissions. The compilation is published on the agency's website. A press release is published together with the publication. Published information is at installation level, but information is also distributed by industry and with the possibility of filtering by geographical areas (municipalities and counties). Emissions per aircraft operator and maritime operator are also published.

Public website of the Union Registry
The Union Registry's public website publishes continuously updated information and statistics on participants in the EU Emissions Trading System.
The website has information on transaction history, free allocation, verified emissions, compliance status and more. Public information is regulated by the Registry Regulation.

The European Commission's website on emissions trading contains a large amount of information on news, legislation, reports, statistics and other information related to emissions trading.

Public information according to decisions under the Kyoto Protocol
Data from the Swedish registry is published in accordance with the provisions of the Registry Regulation and Decision 13/CMP.1 of the Parties to the Kyoto Protocol.
The Swedish Energy Agency regularly sends information to operators in the Union Registry via email. The email addresses used are euets@swedishenergyagency.se, euets@energimyndigheten.se or energimyndigheten@idr.idrelay.com.
